I. General information

The confidentiality of your personal data is one of the principal concerns of Codely Spark S.R.L., with its registered office in Bucharest, Romania, acting as data controller.

The purpose of this document is to inform you about the processing of your personal data in the context of using the website codely.ro.

 

 

II. Categories of personal data processed

II.1. If you are a client of the Site, Codely Spark S.R.L. will process your personal data, such as:

  • first and last name,
  • phone number,
  • email address,
  • details about your project (e.g. type of site, features, budget),
  • data about how you use the Site, for example your behavior within codely.ro,
  • as well as any other categories of data you provide directly when completing the contact form or in any other way arising from your use of the Site.

II.2. If you are a visitor to the Site, Codely Spark S.R.L. will process the personal data you provide directly in the context of using the Site, such as the data you provide through the contact section, to the extent that you contact us in this way.

 

 

III. Purposes and legal bases of processing

III.1. If you are a client of the Site, Codely Spark S.R.L. processes your personal data as follows:

  • for project-related communication, personalized quotes and delivery of services (web development, design, eCommerce, SEO, etc.);
  • for the purpose of carrying out analyses and reports on how the Site functions, primarily with a view to improving the user experience.

You may give your consent to the processing of data for this purpose by ticking the corresponding box when voluntarily completing the contact form.

Providing your data for this purpose is voluntary. Refusing to give consent to the processing of your data will have no negative consequences for you, except that we will be unable to provide you with a personalized quote.

 

⚠️ We do not use your data for direct marketing purposes (e.g. newsletters, promotional SMS), unless you expressly request it.
 
 

IV. How long we process your data

As a principle, Codely Spark S.R.L. will process your personal data for as long as is necessary to achieve the processing purposes set out above.

 
  • If you are a client, we will process your data throughout the duration of our collaboration and thereafter, in accordance with the legal obligations incumbent upon us (e.g. financial and accounting documents — retained for 5 years from the end of the fiscal year, under Law no. 227/2015 on the Fiscal Code).
  • If you withdraw your consent to the processing of data for commercial communication purposes, we will cease processing for that purpose, without affecting processing carried out previously.
 
 

V. Disclosure of personal data

In order to fulfil the processing purposes, Codely Spark S.R.L. may disclose your data to:

  • IT service providers (e.g. hosting, eCommerce platforms, analytics tools),
  • technical partners, strictly to the extent necessary for the delivery of services,
  • public authorities, only where we are legally obliged to do so.
 

Disclosure takes place only within the strictly necessary limits and on the basis of confidentiality agreements.

 
 

VI. Transfer of personal data

The personal data provided to Codely Spark S.R.L. may be transferred within the European Union, in particular to cloud service providers (e.g. Google Workspace, Shopify, European hosting services). We do not transfer data outside the EU, except where an adequate level of protection is ensured in accordance with the GDPR.

Under the conditions laid down by personal data protection legislation, you have the following rights:

  • the right to be informed — to receive details about the processing of your data;
  • the right of access — to obtain confirmation that your data is being processed;
  • the right to rectification — to correct inaccurate data;
  • the right to erasure (the “right to be forgotten”) — where the data is no longer necessary or you withdraw your consent;
  • the right to restriction of processing;
  • the right to data portability — to receive your data in a structured format;
  • the right to object — in particular to any form of direct marketing (although we do not engage in it);
  • the right to lodge a complaint with the National Supervisory Authority or with the competent courts.
